1. DEFINITIONS

The protection of your Personal Data is of great importance to us. Therefore, with this Privacy Policy, we wish to inform you about the processing of your Personal Data, collected through our Website or by other means.

Capitalized terms used in this Privacy Policy have the meaning set out below. In addition, capitalized terms, which are not defined in this Privacy Policy, have the same meaning as set out in our General Conditions of Beeple NV.

Application Means the Beeple application through which the Services are provided to you. Data Protection  LegislationMeans (i) the EU Regulation 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC as from 25 May 2018; (ii) the Belgian law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data and (iii) all other current or future applicable national laws relating to or impacting the processing of personal data and privacy.Personal DataMeans any information relating to an identified or identifiable natural person.PlatformThe software through which the Services are delivered.Services Means the services provided by Us to you, as further described in the General Conditions or as agreed otherwise between you and us, including the management, availability and the operation of the Platform. 2. SCOPE, IDENTITY AND CONTACT DETAILS

2.1. The protection of your privacy and Personal Data is of utmost importance to Us. This Privacy Policy describes how We will process your Personal Data in the context of your use of the Application or Website and as further described in this Privacy Policy. This Privacy Policy applies to the Personal Data we collect via Our Application or Website.

2.2. Beeple NV, a limited liability company incorporated under the laws of Belgium, with registered offices located at Borsbeeksebrug 34/1, 2600 Antwerpen, Belgium, and registered at the Crossroads Bank for Enterprises under the number 0647.889.625; also referred to as “We” or “Us” or “Our”.


2.3. We qualify as a controller, as defined in the Data Protection Legislation, in the light of the processing of your Personal Data for the purposes as defined in the present Privacy Policy.

3. PERSONAL DATA

We will process the following personal data (“Personal Data”) about you:

  • Personal identification data (first name, family name);
  • Contact information (address, e-mail address and telephone number);
  • Your image (optional – only if you upload an image);
  • Location data when using the Application/Website (your coordinates to indicate the geographic position of you).

Your employer or staffing/temp agency may requested you to enter additional data in the Application. Your employer or staffing/temp agency will in such case qualify as a controller in relation to the collection of such additional data.

4. PURPOSES OF PROCESSING AND LEGAL BASIS

4.1. We only process your Personal Data in relation to the following purpose and legal basis.

More specifically your location data will be used to estimate the time remaining for you to get to work. We may calculate the distance from your location to your work and how long it will take for you to get there (estimation). Furthermore, we may verify your location when you check in/out at work via the Application. The location data will also be used and tracked when you don’t use the Application, however only with your explicit consent.· Your consent.

4.2. We will provide you with relevant information if We intend to process your Personal Data for other purposes than those specified in the present Privacy Policy.

4.3. You consent to the processing of (i) your contact information for direct marketing purposes other than those mentioned in article 4.4., (ii) your location and (iii) image for the above-mentioned purposes by ticking the boxes of the Consent Form above. This Privacy Policy is available on Our Website and in the Application and We will keep the original consent form in order to allow Us to demonstrate that you provided Us with your consent. You are entitled to withdraw your consent at every moment. The withdrawal of your consent shall not affect the lawfulness of processing based on consent before its withdrawal.

4.4. In some cases, sending direct marketing by e-mail, SMS or other electronic means is permitted without your consent, for example because we have obtained your electronic contact details in the context of the sale of products or services (e.g. Additional Services within the Application) and because Our commercial messages relate to Our similar products or services (“Soft-opt-in”). You may object at any time to further receiving Our direct marketing messages by clicking on “UNSUBSCRIBE”. The unsubscribe option is provided in each direct marketing e-mail. You may also send your intention to unsubscribe by e-mail to privacy@beeple.eu.

4.5. If you consented therewith, it is possible that we will process your location data. When processing such data, we will only send such data to our server (i) in order for Us to calculate the amount of time necessary for you to get to your work location by comparing the coordinates of those locations and (ii) in order to verify your location when you check in/out at work via the Application. The location data will not be stored by us.

5. RECIPIENTS OF PERSONAL DATA

5.1. Your Personal Data is processed by Us. We may transfer your Personal Data to third parties providing services to Us, such as but not limited to the authentication tools,

marketing offices, IT-service providers and payment service providers.

5.2. We may transfer your Personal Data to third parties if We are required by law or by a judicial order to do so.

5.3. In case of entire or partial sale (including a merger or acquisition) or reorganisation of Us, your Personal Data may be transferred to third parties.

6. TRANSFER OF PERSONAL DATA

6.1. In principle, we will not transfer Your Personal Data outside of the European Economic Area (E.E.A.).

6.2. It is, however, possible that We, through our Processors or sub-processors - transfer your Personal Data to countries outside the EEA. If this happens, and a less strict protection for Personal Data than within the EEA would apply in such country, We will ensure that the same level of protection is achieved.

7. PERIOD FOR WHICH PERSONAL DATA WILL BE STORED

7.1. We will store your Personal Data as long as is necessary to process your Personal Data for the purpose mentioned above, or as long as We are legally obliged to store your Personal Data.

8. YOUR RIGHTS

8.1. In accordance with and subject to the conditions provided by Data Protection Legislation, you are entitled to request from Us (a) access to your Personal Data, (b) rectification of your Personal Data, (c) erasure of your Personal Data and (d) restriction of the processing of your Personal Data. In addition, you have the right to object to the processing of your Personal Data and you may request Us to receive your Personal Data in a structured, commonly used and machine-readable format. You are also entitled to lodge a complaint with the competent supervisory authority (in Belgium the Data Protection Authority https://www.dataprotectionauthority.be) or any other authority replacing the Belgian Data Protection Authority.

8.2. You may exercise the aforementioned rights by sending a letter to Beeple NV, a limited liability company incorporated under the laws of Belgium, with registered offices located at Borsbeeksebrug 34/1, 2600 Antwerpen, Belgium to the attention of the Data Protection Officer, or by sending an e-mail to privacy@beeple.eu or via any other technical solution on Our Website.

9. CHANGES TO THIS PRIVACY POLICY

9.1. We may change the provisions of this Privacy Policy. We will announce each new version of the Privacy Policy and will ask for your consent pursuant to article 4 of this Privacy Policy.
